Acceptance

These terms govern the use of angelspaintings.com, published by Ninefold Press, and the purchase of paintings from Angel Oil Paintings by Art & See. Using the site means accepting them. If you do not accept them, do not use the site.

Who sells the paintings

Paintings on angelspaintings.com are sold by Art & See under the name Angel Oil Paintings by Art & See. Your order is a contract with Art & See, and the charge appears on your card statement under a descriptor that begins with ART&SEE.

What you are buying

Each painting is a reproduction painted by hand, in oil, by one of our artists, from an image of the original. It is not the original work and it is not by the original artist. It is made to order, after you buy it.

Brushwork, texture and colour will differ slightly from the original and from the image on your screen. That variation comes with a painting made by hand and is not a defect. Screens show colour differently, so no image on this site can promise an exact colour match.

Prices and payment

Prices are in US dollars and include shipping to a single address anywhere in the world. They do not include import duties or taxes charged by the country of delivery: the buyer is the importer of record and pays them.

Payment is taken at checkout and processed by Stripe. An order is confirmed once payment is. If a price or a description on the site turns out to be wrong, we may cancel the affected order, even after it is confirmed, and refund it in full.

Production, approval and delivery

A painting usually takes 2 to 3 weeks to make, up to 4 weeks for complex pieces and up to 8 weeks for large ones. Before it ships you receive a photograph of it, and it ships once you approve that photograph. Approving it confirms how the painting looks. The Shipping page on this site sets out packing, tracking and customs in full.

Cancellations and returns

You may cancel within 24 hours of ordering for a full refund. After delivery, the Returns page on this site sets out what can be done within 90 days, and it forms part of these terms. Frames are final sale.

The version of these terms and of the Returns page in effect when you place an order is the one that governs that order.

If something is wrong with an order, write to info@art-and-see.com before opening a dispute with your bank or card issuer. It is almost always the faster way to have it put right.

Old painting, new design: two different questions

The paintings catalogued here are mostly of the fifteenth to eighteenth centuries and are in the public domain as paintings. What can still carry a claim is the photograph: several European institutions assert a right in faithful reproductions of works they hold, while courts in the United States have declined to recognise one. The position differs by country and this site does not resolve it on your behalf.

This subject attracts a specific confusion that is worth stating outright. The two cherubs at the foot of Raphael's Sistine Madonna are among the most reproduced motifs in commercial print, and their ubiquity leads people to assume that every image of them is free to take. It is not. The painting is out of copyright; a particular photograph of it may not be, and a modern illustration, crop, recolour or composite built from it is a new work with its own copyright belonging to whoever made it.

Before reusing an image commercially, check the terms published by the institution named in the entry, and do not assume that a design you have seen elsewhere is in the public domain merely because the painting behind it is. Using the catalogue text

Catalogue facts — a date, a support, a set of dimensions, the name of a collection — are facts, and facts are not owned by anybody. Take them and use them.

The written text of this site is a different matter: it is the work of Ninefold Press and is not offered for republication. Quote it, cite it and link to it freely. Do not copy pages wholesale, and do not feed the site to a scraper that reproduces it elsewhere as though it were its own.

What a rank or a name here is worth

Assigning a figure to a rank, or a name to an archangel, is an editorial reading of the picture. Museum records mostly do not make these distinctions, which means the reading is this site's own and can be wrong. Where a picture will not settle it, the entry says so.

Nothing here is a theological statement, and nothing here should be relied on to authenticate a painting, establish provenance or support a valuation or an insurance claim. It is a finding aid.

No warranty, and limits on liability

The site is provided as it is. No warranty is given that it will be available, that it will be free of error, or that it is fit for any particular purpose. Links to other sites are provided for reference and imply no responsibility for what is on them. Paintings you buy are covered by the sections on orders above and by the Returns page.

To the fullest extent permitted by law, no liability is accepted for indirect or consequential loss arising from use of the site, including loss arising from reliance on anything published here. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, where such a limit would not be permitted.
